Introduction

At ZUNI Learning Tree, we appreciate that parents, guardians, schools, and administrators entrust us with their students’ information, and we are committed to safeguarding student privacy and keeping parents and students informed about our practices. This Privacy Policy outlines our compliance with federal privacy laws and details how we collect, use, share, and protect the information of users of all ages.

Under federal law and on the basis of our commitments with schools, school districts, or independent teachers, ZUNI Learning Tree is permitted to receive information about students in the context of school subscriptions. When a parent or guardian creates an account with ZUNI Learning Tree, he or she is required to give permission in the form of verifiable consent for ZUNI to receive information about his or her child. These permissions include the practices described in this Privacy Policy.

A teacher or school official often will be in the best position to address questions or concerns with the handling of student information in the classroom, including when using our services. In addition, specific questions about this policy may be sent to ZUNI Learning Tree at the address listed below in Section 4: Your Privacy Rights.

1.What Information We Collect

When a parent, guardian, teacher, administrator, school, or district opens an account with ZUNI Learning Tree, we may collect personally identifiable information about the user such as:

  • First and last name
  • Student ID number
  • Home address
  • Email address
  • Phone number
  • Photos
  • Videos

ZUNI Learning Tree may also collect other information that, when combined together or reviewed by a familiar person, could be used to identify a user. This information may include birthday, grade level, language, gender, race, ethnicity, economic status, conversations inside the ZUNI platform, school assignments, and tests and test results. Altogether, in this Privacy Policy we refer to the above types of information as Personally Identifying Information, or PII.

We may also retain some information about individual usage including: the Internet protocol address used to visit our site; browsing information including sites visited after visiting our site; and other usage data from a user’s browser, mobile phone or other device. In this Privacy Policy we refer to this information as Non-Personal Information. We may make that information anonymous by removing all Personally Identifiable Information, and in this Privacy Policy we refer to that de-identified data as Anonymous Information.

If a user visits our site or service using a browser with “Do Not Track” settings, we will accommodate those preferences to the extent possible.

2.What we do with the information we collect

Together with teachers and school administrators, we may use Personally Identifiable Information, and may combine it with Non-Personal Information, for the following purposes:

  • Facilitating communications among teachers and students,
  • Administering assessments and quizzes,
  • Delivering and completing assignments,
  • Keeping student portfolios of completed projects and other work,
  • Facilitating digital classroom projects such as non-public websites,
  • Sending users updates about ZUNI Learning Tree products and services,
  • Providing teachers and school administrators with information about the learning interests and needs of students and teachers,
  • Developing personalized learning paths for students, and
  • Responding to customer and technical support inquiries from our users.
We may use Anonymous Information for the following purposes:
  • Allowing third parties, on the basis of the collective behavior of our users, to develop marketing, education, or other strategies,
  • To refine our services we offer to you and to improve our products and services overall.

Teachers and school administrators may seek to work with third parties for purposes specific to the needs of a particular class, school, district, or group of students. In those cases, the teachers or school administrators will obtain additional consent from parents and guardians regarding the details of the collection and use of information that will be involved.

Complying with applicable laws, regulations, or subpoenas or other lawful requests by enforcement authorities. In addition to the above purposes, we might share information, including PII, to government or law enforcement officials if we believe it is necessary to comply with the law, to meet national security requirements, or to protect us, our customers, or third parties from illegal, unauthorized, or unethical activity.

3.International

BY ACCEPTING THIS PRIVACY POLICY, USERS RESIDING OUTSIDE THE UNITED STATES ACKNOWLEDGE THAT ZUNI LEARNING TREE OPERATES IN COMPLIANCE WITH, AND IS SUBJECT TO, U.S. PRIVACY LAWS, WHICH MAY DIFFER MATERIALLY FROM THE LAWS AND REGULATIONS OF YOUR RESIDENT JURISDICTION. YOU AGREE THAT THE PERSONALLY IDENTIFIABLE INFORMATION PROVIDED TO ZUNI LEARNING TREE MAY BE TRANSFERRED AND STORED IN COUNTRIES OTHER THAN A USER’S RESIDENT JURISDICTION, IN ACCORDANCE WITH THIS PRIVACY POLICY AND THE TERMS OF THE APPLICABLE SUBSCRIPTION, AND SUBJECT TO APPLICABLE LAW.

4.Your Privacy Rights: Accessing, Updating, Deleting, and Opting-Out

As long as ZUNI Learning Tree maintains an account for an individual student, the following choices will be available:

  • Parents, guardians, non-minor students, teachers, and school administrators may update or correct PII.
  • Under the Family Educational Rights and Privacy Act (FERPA), parents, guardians, and eligible students have the right to inspect and review the records a school keeps about your student’s or your education. These individuals also have the right to request corrections to a those records if they believe the records are inaccurate, misleading, or otherwise in violation of their rights under FERPA.
  • Teachers and school administrators may delete PII or delete user accounts entirely, including at the request of parents, guardians, or non-minor students when appropriate.
  • Parents, guardians, and non-minor students may choose to delete a student’s ZUNI Learning Tree account entirely after he or she has left a class, school, or school district.
  • If consent has been obtained by a teacher or school administrator to disclose PII to third parties for a specific purpose, and that disclosure involves information from ZUNI Learning Tree accounts (see Section 2 above), we will facilitate requests to opt out of those disclosures.
  • Users may unsubscribe from our promotional emails at any time by following the unsubscribe instructions included at the bottom of each email.

You may exercise these rights by contacting us at zuniteam@zunilearningtree.com. Complaints will be addressed by the U.S.-based dispute resolution provider that ZUNI Learning Tree has designated as detailed in the Terms of Service.

ZUNI Learning Tree is part of a connected world. Please be aware that if you interact with and provide your personal information to a third party service that leads you to our websites or services, we can make no representations as to how your information is handled before it reaches us. It is your responsibility to be aware of the policies of such services, and to choose whether and how to share your personal information accordingly. Similarly, when a ZUNI Learning Tree user clicks on a link to an outside website or service from within the ZUNI Learning Tree platform, that user may submit information, including PII, to third parties that is not subject to this Privacy Policy.

5.Security and Data Storage

We work with trusted third parties that take steps to secure user information, including technical and administrative measures to safeguard the PII you provide, and that use encryption when collecting or transferring sensitive personal information. We periodically review our security processes to ensure that they comply with our standards. However, various security breaches, such as viruses and hacker attacks, may be out of our control. In the event of a data breach, we will notify you in accordance with applicable law about how your information might be affected.

6.Updates

We will communicate any changes to this Privacy Policy by posting them on this webpage, and noting the most recent date of any changes. If there are material changes to this Privacy Policy, we will notify subscribers and former subscribers for the purposes of obtaining renewed consent. This Privacy Policy was most recently updated on August 8, 2016. We might, in the future, launch new websites, services, or partnerships in affiliation with ZUNI Learning Tree, to which this Privacy Policy will also apply.

7.Additional Terms

The practices described in this Privacy Policy apply to the use of ZUNILearningTree.com or any of our affiliated websites, the use of any of our live or digital services, and any communications to us in person, on the phone, or electronically. This Privacy Policy is subject to all of the terms laid out in our Terms and Conditions, including but not limited to the provisions regarding termination of services, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.
